Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Starz mobile application ("Starz" or "the App") operated by Gabriele Rizzo ("I", "me", "my").

Your access to and use of Starz is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using Starz, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access Starz.

Eligibility

You must be at least 13 years old to use the App and agree to these Terms. If you are under 18 years old (or the age of majority in your jurisdiction), you represent that you have reviewed these Terms with your parent or legal guardian, who agrees to these Terms on your behalf.

Accounts

When you create an account with me, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Starz.

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password, whether your password is with my App or a third-party service. You agree not to disclose your password to any third party. You must notify me immediately upon becoming aware of any breach of security or unauthorized use of your account.

Intellectual Property

The App and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of Gabriele Rizzo and his licensors. The App is protected by copyright, trademark, and other laws of both Italy and foreign countries. My trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Gabriele Rizzo.

You retain all rights to the images you upload to Starz and the enhanced images you create using the App. I do not claim any ownership rights over your images or the content you create with the App. As stated in the Privacy Policy, images are processed locally on your device and are not stored on my servers.

Prohibited Uses

You agree not to use the App:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation.
• To impersonate or attempt to impersonate Gabriele Rizzo, a Starz employee, another user, or any other person or entity.
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App, or which, as determined by me, may harm Gabriele Rizzo or users of the App or expose them to liability.
• To reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App.
• To introduce any viruses, Trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App.
• To create or process images that are illegal, harmful, or infringe on copyrights or other intellectual property rights of third parties.

Subscriptions and Payments

Starz offers subscription plans (monthly or yearly) that provide access to certain features. These subscriptions are auto-renewing by default.

• Auto-Renewal: Your subscription will automatically renew at the end of each billing period (monthly or yearly) unless you disable auto-renewal. You can manage your subscription settings and disable auto-renewal through your device's app store settings (e.g., Apple App Store, Google Play Store).
• Cancellation: You cannot directly cancel an active subscription. However, by disabling auto-renewal, your subscription will not renew, and your access to premium features will revert to the free version at the end of your current active billing period.
• Refunds: All subscription payments are final, and no refunds will be issued for any unused portion of a subscription period, regardless of the reason for termination or non-use.

All payment transactions are processed securely by a third-party payment processor, Stripe. Your use of Stripe's services is subject to their terms and conditions and privacy policy. I do not store your payment card details.

Termination

I may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under my sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Reasons for termination may include, but are not limited to, misuse of the App or violation of these Terms.

Please note that currently, users do not have the functionality to self-terminate or delete their accounts within the App. If you discontinue using the App, your account will remain active until terminated by me in accordance with these Terms. Upon termination by me, your right to use the App will immediately cease.

Disclaimer of Warranties

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Gabriele Rizzo does not warrant that a) the App will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the App is free of viruses or other harmful components; or d) the results of using the App will meet your requirements.

Limitation of Liability

In no event shall Gabriele Rizzo, nor his directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not I have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Indemnification

You agree to defend, indemnify, and hold harmless Gabriele Rizzo and his licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; b) a breach of these Terms; or c) your misuse of the App or violation of these Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms of Service, including the formation, interpretation, breach, or termination thereof, shall be finally settled by arbitration in Italy in accordance with the rules of a recognized arbitration institution (e.g., the Arbitration Chamber of Milan, if applicable, or a similar recognized body). The language of the arbitration shall be Italian. The decision of the arbitrator(s) shall be final and binding on both parties.

My failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding my App and supersede and replace any prior agreements we might have had regarding the App.

Changes to These Terms

I reserve the right, at my sole discretion, to modify or replace these Terms at any time. If a revision is material, I will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at my sole discretion.

By continuing to access or use my App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
